Terms of Service
1. Acceptance
By accessing or using pokedaily.net (the "Site"), you agree to these Terms. If you do not agree, do not use the Site. The Site is free to use and provided as-is.
2. Fan project disclaimer
Daily Pokemon is an unofficial fan-run editorial project. It is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK, or any other rights-holder of the Pokémon franchise. All Pokémon names, character likenesses, sprites, cries, and franchise assets are the trademarks and copyrighted property of their respective owners. We claim no ownership of any franchise IP.
The Site presents Pokémon information under fair-use principles for the purposes of commentary, criticism, education, and news reporting. If you are a rights-holder and believe any content infringes your rights, contact hi@pokedaily.net and we will respond promptly.
3. Our content
Editorial content authored by Daily Pokemon (written summaries, video transcripts, design, layout, code, illustrations, and original commentary) is © Daily Pokemon. Reproduction is permitted for non-commercial purposes with attribution and a link back to the source page. Commercial reuse requires written permission.
Stat data, sprites, cry audio, and other Pokémon-franchise assets surfaced through the Site are sourced from public Pokémon data resources and community projects. Some of these resources are licensed under Creative Commons (e.g. CC-BY-NC-SA); where attribution is required by the source's license we credit the source on the relevant content page. All such assets remain the property of their respective rights-holders.
4. Acceptable use
You agree not to:
- Scrape the Site at a rate that materially impacts performance for other visitors. Reasonable automated access (search-engine crawlers, AI-citation crawlers honoring our
/llms.txt) is welcome. - Attempt to bypass authentication or access non-public administrative areas.
- Submit deliberately misleading content via the "Request a Pokémon" form or any contact channel.
- Use the Site to host or distribute malware, phishing, or any unlawful material.
- Misrepresent yourself as the operator of the Site.
5. User submissions
If you submit content (an email address, a Pokémon request, an idea), you grant Daily Pokemon a non-exclusive, royalty-free, worldwide license to use that submission for the purpose of operating the Site. You retain ownership. We will not publish your email address or contact information without permission.
6. Third-party services and links
The Site embeds and links to third-party content (video players, social media accounts, news sources, partner sites). We do not control these services and are not responsible for their content, availability, privacy practices, or terms. Use them at your own risk.
7. No warranty
The Site is provided as-is and as-available, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be available without interruption, accurate, complete, or free of errors.
8. Limitation of liability
To the maximum extent permitted by law, Daily Pokemon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Site. Our total cumulative liability shall not exceed USD $50.
9. Termination
We reserve the right to suspend or terminate access to the Site for any user who materially violates these Terms, without notice. You may stop using the Site at any time.
10. Changes to these Terms
We may update these Terms from time to time. The Effective date at the top of this page reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in New York County, New York.
